1. General Provisions
These Terms of Service govern the use of the KrakowPlaces internet service available at krakowplaces.com, operated by KrakowPlaces, ul. Zamknięta 10/1.5, 30-554 Kraków, Poland, email: contact@krakowplaces.com. Use of the service constitutes acceptance of these Terms.
2. Definitions
Terms used in these Terms of Service mean:
- Service - the KrakowPlaces internet platform available at krakowplaces.com
- User - a natural person using the Service
- Guide - a digital product containing information about places in Krakow, available through the Service
- Service - provision of access to Guides through the Service
- Administrator - KrakowPlaces
3. Rules for Using the Service
The User undertakes to use the Service in accordance with the law, good customs and the provisions of these Terms. It is prohibited to: use the Service for illegal purposes, attempt to breach Service security, copy or distribute content without the Administrator's consent, use automated systems to download content (except as permitted by the Administrator).
4. Registration and User Accounts
Some Service features require creating a user account. Registration is done through the Clerk authentication provider. The User undertakes to provide true and current data. The User is responsible for maintaining the confidentiality of login data. The Administrator is not liable for damages resulting from unauthorized use of the user account.
5. Payments and Refunds
Payments for Guides are processed by Stripe. Prices are given in Polish zloty (PLN) and include VAT if applicable. In accordance with the Consumer Rights Directive (2011/83/EU) and the Consumer Rights Act, the consumer has the right to withdraw from the contract within 14 days of purchase without giving a reason. To exercise the right of withdrawal, send a statement to: contact@krakowplaces.com. Refunds will be made within 14 days of receiving the statement. The right of withdrawal does not apply if the Guide has been fully provided and the user has consented to start the service before the withdrawal period expires.
- Payments are processed securely by Stripe in accordance with PCI DSS certification
- All prices include VAT if applicable
- Right to withdraw from contract: 14 days from purchase (in accordance with Consumer Rights Directive)
6. Intellectual Property
All content available in the Service, including texts, photos, maps, place descriptions, is protected by copyright and is the property of KrakowPlaces or is used under appropriate licenses. It is prohibited to copy, distribute, modify or use content for commercial purposes without written consent from the Administrator. The User acquires the right to use the purchased Guide solely for personal, non-commercial use.
7. Liability
The Administrator makes efforts to ensure that information in the Guides is current and reliable, but does not guarantee its completeness or currency. The Administrator is not liable for: changes in places described in the Guides (opening hours, prices, availability), user decisions made based on information from the Guides, damages resulting from use or inability to use the Service, Service interruptions caused by external factors. The Administrator reserves the right to make changes to the Service, including temporary suspension of access.
8. Final Provisions
The Administrator reserves the right to change these Terms. Users will be informed of changes by publishing an updated version on this page. Matters not regulated by these Terms shall be governed by Polish law, in particular the Civil Code, the Act on Provision of Electronic Services and the Consumer Rights Act.
9. Applicable Law and Dispute Resolution
All disputes arising from the use of the Service shall be governed by Polish law. In case of disputes with consumers, the consumer has the right to use out-of-court methods of handling complaints and pursuing claims, including the possibility of using the ODR (Online Dispute Resolution) platform available at: https://ec.europa.eu/consumers/odr/. Disputes will be resolved by courts with jurisdiction in accordance with Polish law.
